The Court of Appeal, Kano Division, on Tuesday, nullified the judgment that erroneously sacked Chief Victor Ike Oye as APGA National Chairman.

The Special Panel of the court led by Justice Tsammani held that Justice Musa Ubale of Birkin Kudu Division of Jigawa State High Court was biased in handling the case having contravened section 36 of the 1999 Constitution of Federal Republic of Nigeria since Supreme Court has held that no man can ever have a verdict entered against him on a matter relating to his Civil Rights or Obligations before a Court or Tribunal without being given an opportunity of being heard and lacks jurisdiction to adjudicate the matter.

The three-member panel of Justices: Tsammani JCA (Presiding), Maiwada Abdullahi JCA and Musale JCA in an unanimous judgement while declaring that Mr. Jude Okeke and his group are “meddlesome interlopers”, held that the proceedings of the Jigawa High Court which led to wrongfully sack of Chief Victor Oye as party National Chairman, thereafter, ordering INEC to recognize Jude Okeke “purported” faction must not be allowed to stand because it’s untenable, miscarriage of justice, and rascality of politicians because Jigawa State High Court lacks jurisdiction to adjudicate the matter.

During the ruling, the Learned Judges agreed with Appellant counsel that APGA national leadership matter is not pre-election matter because a matter cannot become a pre-election matter at the Court of Appeal that was not a pre-election matter and filed within 14 days at the lower court. The alleged APGA Convention was held in 2019, and not in 2021, therefore a time frame doesn’t apply, Appeal Court declared!

Nullifying the Jigawa purchased judgment, Appellant court also ordered Jude Okeke, Hon. Umeoji and Lilian Orogbu to pay heavy sum to APGA and Oye, and ordered INEC to rise up and take responsibility.

The Appellant court was clear when it said that Learned trial court showed biase against the Appellant. From evidence before the court, Jude “Maradona” Okeke misled the court without even filing a single document to show legitimacy over their claims.
