A federal high court has acquitted suspended deputy police commissioner Abba Kyari and his two brothers of charges accusing them of concealing assets and submitting false declarations, citing a lack of evidence from anti-narcotics authorities.
The ruling by Justice James Omotosho at the Federal High Court in the capital dismissed the 23-count indictment filed by the National Drug Law Enforcement Agency.
The charges alleged non-declaration of various properties, including land in Fountain Estate, Kasana, sites on Linda Choko Road in Asokoro, and holdings in Maiduguri, Borno State, some purportedly inherited from their late father or owned by a relative.
Omotosho faulted the NDLEA for not producing key proofs, stating the agency presented “no credible documents such as title deeds, traditional history, acts of possession, or evidence of connection to establish ownership.”
He noted that Kyari’s claim of inheriting the Maiduguri properties from his deceased father “was not disproved,” and added that the conspiracy allegations against the brothers “lacked substantiation.”
The court discharged all defendants on every count.
