A Massachusetts judge declared a mistrial Friday in the high-profile murder trial of Lindsay Clancy after jurors said they could not reach a unanimous verdict following seven days of deliberations.
The jury of nine women and three men sent a note to the court stating: “It is with heavy heart we are still unable to come to a decision and will not be able to.” Superior Court Judge William Sullivan then announced he had “no choice but to declare a mistrial.”
Clancy, 36, was charged with three counts of first-degree murder in the January 2023 deaths of her children — Cora, 5, Dawson, 3, and Callan, 8 months — whom she strangled with exercise bands in the basement of the family’s home in Duxbury. She later jumped from a second-story window in a suicide attempt that left her paralyzed from the waist down.
Her defense argued she was suffering from postpartum psychosis and lacked criminal responsibility. Prosecutors maintained the killings were intentional and planned.
Defense attorney Kevin Reddington said after the mistrial that 11 jurors favored acquittal and blamed a single holdout. “They know that they were robbed by one man who, for whatever reason, stole seven weeks of the other jurors,” he said. When asked about Clancy’s condition, he replied simply: “She’s not good.”
Plymouth County District Attorney Timothy Cruz said his office had not yet decided whether to retry the case. “This case has always been about those three children. We are here today because they are not,” Cruz told reporters.
A status hearing is scheduled for Sept. 29. Clancy remains held at a state mental health facility.
